Neutral Citation No. - 2025:AHC:42628-DB Court No. - 29 Case :- WRIT - C No. - 8443 of 2025 Petitioner :- Ankit Tomar Respondent :- Union Of India And 2 Others Counsel for Petitioner :- Akhilesh Kumar Singh,Chandra Jeet Yeadav Counsel for Respondent :- A.S.G.I. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Vakalatnama filed by Shri Piyush Mishra, Advocate on behalf of respondent no.3 is taken on record. This petition seeks a writ of mandamus to command the Union authorities to compensate the petitioner by payment of Rs.15 lakhs on account of delay in providing the passport to the petitioner. According to the petitioner under the Schedule, passport is to be provided within a period of 8-14 days. Shri Piyush Mishra, for the respondent submits that time frame specified for issuing the passport is directory and not mandatory. The Schedule under the Passport Rules prescribes the time limit within which the passport is to be sent. In the present case, the period within which the passport is to be issued is 14 days. For the alleged delay of about 7 days, we fail to understand as to how and why the amount of Rs.15 lakhs is to be paid to the petitioner. Even otherwise, for any claim of damages etc, remedy of the petitioner would lie before the competent civil court. Accordingly, the present writ petition is dismissed.
