25.08.2025 Item No.31 Ct.No.34 rc. Reject C.R.M. (M) 983 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station Case No. 474 of 2023 dated 22.04.2023. And In Re : Asif Sk @ Amjed Sk @ Amjed Sekh ... Petitioner Ms. Sabrina Parveej ... for the Petitioner Mr. Joydeep Roy Mrs. Trina Mitra ... for the State The petitioner is in custody for more than two years and renews his prayer for bail. Learned counsel for the petitioner submits that grounds of arrest were not stated to the petitioner at the time of his arrest. The prosecution proposes to examine twenty nine witnesses. There is remote chance of trial being concluded in near future. Learned counsel for the State opposes the prayer. I have considered the material on record. This is a case of double murder and injury inflicted upon another person. Most of the witnesses have implicated the petitioner in the alleged crime. The offending weapon has been recovered at the instance of the petitioner. The petitioner is in custody for more than two years. Offence, if proved, shall attract mandatory life imprisonment. Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage. The bail application is disposed of. Case Diary is returned. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.) 2
