JUSTICE S SUNIL DUTT YADAV ORAL ORDER The present petition has been filed seeking for issuance of writ in the nature of mandamus to direct the 2nd respondent to hold 'fresh hearing' in Appeal No.151/2009-10 pending on the file of the 2nd respondent. 2. The case made out by the petitioner is that the matter has been posted for judgment while the arguments - 3 - HC-KAR NC: 2025:KHC:25717 WP No. 20726 of 2025 were heard by the previous officer and not by the present presiding officer. 3. Learned Additional Government Advocate fairly submits that the matter would be reheard. Accordingly, the matter requires to be disposed off. Learned Additional Government Advocate makes a plea that as the matter relates to the year 2006-2007 the petitioner must be directed to cooperate in expeditious conclusion of the proceedings and not to take multiple adjournments. 4. Learned counsel for the petitioner submits that petitioner would complete the arguments on the next date. Taking note of the stand of both parties, petition is disposed off with a direction to the respondent - Authority to hear the petitioner and dispose off the matter. All contentions are kept open.
