The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita, has been filed to quash the entire proceedings of Criminal Case No. 25476 of 2023, (State Vs. Shahrookh and others) arising out of Case Crime No. 298 of 2023, under Sections 452, 323, 336, 506 of I.P.C., Police Station- Kharkhoda, District- Meerut, as well as cognizance/ summoning order dated 02.11.2023 pending in the Court of Additional Chief Judicial Magistrate, Court No. 5, Meerut. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
