THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE H.P.SANDESH ORAL ORDER This petition is filed under Section 407 of Cr.P.C praying this Court to transfer the Spl.C.No.10/2024 in Cr.No.97/2014 from the Principal District and Sessions Judge, Mysuru to the Court of XLVIII Additional City Civil and Sessions Judge, Bengaluru for trial and disposal together in accordance with law. 2. Heard the learned counsel appearing for the respective parties. - 4 - NC: 2025:KHC:16294 CRL.P No. 8271 of 2024 3. The counsel would contend that the allegation for charges in all 41 charge-sheets are similar against the petitioners that they being the Managing Director and Directors of the Company have received the money from the public and failed to repay the same. The counsel brought to notice of this Court the order dated 29.11.2021 of the coordinate Bench of this Court which is produced as Annexure-B wherein the coordinate Bench has transferred the cases which have been mentioned in the operative portion to XLVIII Additional City Civil and Sessions Court, Bengaluru City for adjudication and details are given and while transferring the same, it is observed that since the interest of the depositors are involved, the transferee court may expedite the trial and also directed the prosecution and the accused to cooperate with the Trial Court for speedy disposal and also while disposing of the same made an observation that the records at other places shall be transmitted to the Special Court at Bengaluru within 23.12.2021, the date on which the case - 5 - NC: 2025:KHC:16294 CRL.P No. 8271 of 2024 is said to be fixed at Bengaluru. The counsel referring this order would vehemently contend that this matter may be transferred to the said Court in order to protect the interest of the depositors and a direction may be given to the prosecution and also the petitioners to assist the Court in disposal of the same as expeditiously as possible. 4. The learned counsel appearing for the State would submit that when the connected matters are transferred to the XLVIII Additional City Civil and Sessions Judge, Bengaluru, this matter also can be transferred to the said Court. 5. In view of the submission of both the counsel and also having taken note of the fact that similar issue was considered by this Court vide Annexure-B and in the light of the directions given by the co-ordinate Bench of this Court, this case is also directed to transfer from the Principal District and Sessions Judge, Mysuru to XLVIII Additional City Civil and Sessions Judge, Bengaluru as prayed and the Trial Court is directed to dispose of the - 6 - NC: 2025:KHC:16294 CRL.P No. 8271 of 2024 same as early as possible in accordance with law. Accordingly the petition is disposed of. 6. In view of disposal of the petition, I.A. if any, does not survive for consideration and the same stands disposed of. Sd/- (H.P.SANDESH) JUDGE SN
