Basant Singh Thakur and others Vs. State of H.P. & Ors. CMP-T No.556 of 2025 in Exe. Pet. No.185 of 2024 01.01.2026 Present: Mr. Naresh Kaul, Advocate, for the applicants/petitioners. Mr. Anup Rattan, Advocate General, with Mr. Rajat Chauhan, Assistant Advocate General, for for the non-applicants/ respondents-State. Dr. Sanjeev Dhiman, Director, Animal Husbandry, Govt. of H.P., present in person. Learned Advocate General apprised the Court that in compliance to the judgment passed by the Court, the work-charge-status was conferred upon all the petitioners post completion of ten years of service as daily wagers. Learned Advocate General further apprised the Court that all the petitioners were regularized in the year 2006 and were given the wages as were payable to a regular employee as from the date of regularization. He further submitted that in terms of the judgment passed by this Court, the direction was to confer actual benefits upon the petitioners which would be following from the judgment from the date three years preceding the filing of the petition. He submitted that as from the date three years preceding the filing of the petition, nothing is now due to the petitioners as all emoluments which were payable to them stood paid and in fact, if the petitioners still insist for implementation of the judgment in issue in letter and spirit, it may result in a situation where recoveries might have to be effected from them. Faced with this situation, learned Counsel for the petitioners submits that the matter be taken up on 05.01.2026. Ordered accordingly. As prayed for, list on 05.01.2026.
