1. This is third bail application seeking grant of bail to the Applicant who is in jail since 11.07.2024 in connection with Crime No.164/2024 registered at Police Station Chirmiri for the offence punishable under Section 294, 323, 506 and 302/34 IPC.
2. The first bail application of the applicant was dismissed as withdrawn with liberty to repeat the same after examination of material witnesses on 14.11.2024 in MCRC No.6770 of 2024. The second bail application was dismissed on 28.02.2025 in MCRC No.1351 of 2025 on the ground that applicant himself took time to argue the matter on framing
2 charge and for this reason charge could not be framed till 27.02.2025 and as such there was no change in circumstances on that day.

Learned Counsel for the applicant would submit that the applicant is in jail since 11.07.2024 and therefore he may be enlarged on bail as trial is getting delayed.
4. On the other hand the counsel for the State opposes the bail application on the ground that trial is in progress and as of now out of total 15 witnesses, 5 witnesses have already been examined.

Considering the submissions made by the counsel for the parties, considering the nature and gravity of offence, the material collected during investigation and also considering the fact that trial of the case is in progress and out of 10 witnesses 5 witnesses have already been examined, I do not find any good ground admit the bail application and to release the applicant on bail.
6. Accordingly, the third bail application also stands dismissed at motion stage. Sd/- (Ravindra Kumar Agrawal) Judge inder
