CORAM : MANGESH S. PATIL & PRAFULLA S. KHUBALKAR , JJ. DATE : 03.03.2025 PER COURT : By way of these separate writ petitions, the petitioners are challenging common judgment and order passed by the scrutiny committee invalidating their ‘Koli Malhar’ scheduled tribe certificates.
2. We have heard both the sides.
3. The impugned order is not only common for these two petitioners, but even in respect of a claim of one Pradip Harischandra Gavli. On his challenge to the self-same order in Writ Petition No. 13844/2021, by the
order dated 27.11.2024, his petition was allowed partly. The impugned
judgment and order to his extent was quashed and set aside and he was
directed to be issued with ‘Koli Malhar’ scheduled tribe validity certificate, co-terminus with the validity which the petitioners have been relying upon, which the committee has decided to reverify.
4. Since it is a matter of common judgment and order, this division bench cannot once again undertake any fresh scrutiny much less to arrive at a different conclusion.
5. For the reasons recorded by the division bench in the matter of Pradip (supra), even these petitions are allowed partly. 2/3

6. The impugned order is quashed and set aside even to the extent of these petitioners. The respondent-committee shall immediately issue tribe validity certificates to the petitioners as belonging to ‘Koli Malhar’ scheduled tribe. The validities shall be co-terminus with the validities of earlier validity holders, which the committee has decided to reopen.
7. The petitioners shall not be entitled to claim equities.
