GP FOR SERVICES II The Court made the following: 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY W.P.No.23123 of 2025 O R D E R: The present Writ Petition is filed to declare the action of the Respondents in disqualifying the Petitioner for the post of School Assistant (Physical Education) in DSC Examinations- 2025 on the ground of mismatch of caste details despite production of valid Caste Certificate of Beda (Budga) Jangam (SC Gr-I) under Non Local Category as illegal and arbitrary and in violation of the principles of natural justice. 2. The Petitioner is an aspirant for the 2025 Teacher Recruitment Notification conducted by the Respondents. The Petitioner had applied for the post of School Assistant (Physical Education) under the Scheduled Caste (Group-I) category and secured 72 marks and stood at rank 81 in the merit list for SA (PE) and received a certificate verification call letter. In the Certificate Verification conducted on 28.08.2025 at S.V. College of Engineering and Technology, Muthirevula, Chittor, the case of the Petitioner was not considered on the ground that the caste mentioned in the application form is “Bavuri” and 3 the Caste Certificate is “Beda (Budga) Jangam (SC Grade-I),” and as there is a variation in the caste particulars, the case of the Petitioner was not considered. Hence, the present Writ Petition. 3. Sri G. Ramachandra Rao, learned Government Pleader would submit that the Petitioner cannot be considered in the SC quota, as ‘Beda (Budga) Jangam’ is not recognized as a Scheduled Caste as per the Andhra Pradesh Scheduled Castes (sub-Classification) Rules, 2025, issued vide G.O.Ms.No.7, dated 18.04.2025.The learned Government Pleader further submits that the Community Certificate filed by the Petitioner was issued in the State of Telangana, and the same could be relevant when the recruitment is in Telangana and not in the State of Andhra Pradesh. 4. 4. Learned counsel for the Petitioner in reply submits that as the Petitioner had secured good marks in the DSC examinations, 2025, the case of the Petitioner can be considered on its own merits in the OC Non-Local Category. . 4 5. Considering the submissions made, the present Writ Petition is disposed of with the following directions: (i) The Respondents are directed to consider the case of the Petitioner for recruitment as School Assistant (Physical Education) on the basis of the marks secured in the DSC Examination, 2025, under O.C. Non Local Category. (ii) There shall be no order as to costs.
