Mr. Akshay Joshi, learned counsel for the applicant. Mr. V.S. Pal, learned A.G.A. for the State. Mr. Saurabh Kumar Pandey, learned counsel for the complainant. 2. The applicant – Suresh Ram @ Suriya, who is in judicial custody in connection with FIR/Case Crime No. 42 of 2025, under Section 64(2)(k) of BNS, registered at P.S.- Kotwali, District Pithoragarh, has sought his release on bail. 3. In this case, brother of the victim lodged an FIR on 20.03.2025, wherein, it was alleged that victim was deaf and dumb and rape was committed upon her by the applicant due to which she got pregnant and after six-seven months when this fact came to their knowledge, the present FIR was lodged. Baby boy was delivered on 11.04.2025 and DNAs of the new borne baby, applicant and the victim were sent for DNA examination. 4. Learned counsel for the applicant would submit that the applicant has falsely been implicated in the case. 5. Today, learned State Counsel has supplied the report of the Forensic Science Laboratory. The same is taken on record. In the report, it is mentioned that the applicant is the biological father of the new borne son and the victim is the biological mother. 6. Having considered the facts and circumstances of the case, this Court is of the view that prima facie, prosecution has been able to establish the involvement of the applicant in the crime. Thus, there is no good ground to enlarge the applicant on bail and the present bail application deserves to be rejected. 7. Accordingly, the present bail application is hereby rejected.
