ORDER:
The present Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:
“….to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondent Nos.3 & 4 in making efforts to mutate the name of the 5th respondent in respect of the lands to an extent of Ac.3.71 1/3 cents in RS.No.321, Ac.0.41 cents in RS.No.321, Ac.0.23 cents in RS No.321 Ac.0.40 cents in RS.No.321, Ac.0.15 cents in RS.No.322/5, Ac.0.12 ¾ cents in RS.No.315of Pippara Village, Ganapavaram Mandal, West Godavari District pending disposal of the suit in O.S.No.06 of 2021 on the file of the Civil Judge (Senior Division) Tadepalligudem, West Godavari District as illegal, improper, unjust, arbitrary, contrary to the provisions of AP Rights in Land and Pattadar Pass Book Act, 1971 and violation of Article 14, 21 & 300A of the Constitution of India and consequently direct the respondents not to mutate the name of the 5th respondent and pass such order or orders….”
2. Succinctly the case of the petitioners is to direct the respondents not to mutate the name of the 5th respondent in the revenue records. 3. Learned Assistant Government Pleader placed written instructions, dated 02.09.2025, addressed by the Tahsildar,
4 Ganapavaram to the Government Pleader for Revenue, High Court of Andhra Pradesh, Amaravati, part of the record.
Wherein, it is emphasized that the mutation of the application No.MUT250821005294, Dt.21.08.2025, filed by the 5th respondent i.e. Smt. Kothapalli Sudha Rani will be rejected on 07.09.2025, since civil suit is pending before the Court and also there is no possession to applicant (5th respondent) on subject lands. 3. Recording the same, the Writ Petition is closed. There shall be no order as to costs.
