[2025:RJ-JP:5559] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 385/2025 Meghraj S/o Murarilal, Aged About 21 Years, R/o Ajnoti, Police Station Surwal, District Sawai Madhopur. At Present Confined At Jail, Sawai Madhopur. ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Shiv Jangir Mr. Satyendra Tanwar Mr. Jay Bhardwaj Mr. Garvit Saraswat For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 07/02/2025 The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 04/2025 registered at Police Station Mantown, District Sawaimadopur for the offence(s) under Sections 318(4), 319(2), 316(2), 336(3), 338, 340(2), and 61(2) (a) of BNS and Section 13 of Rajasthan Public Gambling Ordinance, 1949 and 66d of IT Act. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. Offences alleged to have been committed by the petitioner are triable by Magistrate. The accused petitioner is in custody since 03.01.2025 and there are no criminal antecedents against the petitioner. The trial of the case will take considerable time. Therefore, the benefit of bail may be granted to the accused-petitioner. [2025:RJ-JP:5559] (2 of 2) [CRLMB-385/2025] Per contra, learned Public Prosecutor opposes the bail application and contended that petitioner was arrested by the police and from his possession two mobile phone alongwith sim card were recovered. Petitioner has created a telegram channel and was involved in uploading misleading advertisement and messages and has obtained money through UPI from many persons, therefore considering the above facts, his bail application deserves to be dismissed. Heard and perused the material available on the record. Considering the fact that petitioner is behind the bar since 03.01.2025 and trial of the case will take considerable time. Offences alleged to have been committed by the petitioner are triable by Magistrate. There are no criminal antecedents against the petitioner. Therefore, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Meghraj S/o Murarilal, in connection with FIR No. 04/2025 registered at Police Station Mantown, District Sawaimadopur shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
