30.07.2025 Sl. No.33 Ct. 28 NB
C.R.M. (A) 2352 of 2025
In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Palashipara P.S. Case No.227 of 2025 dated 18.05.2025 under Sections 126(2)/115(2)/109/77 of Bharatiya Nyaya Sanhita, 2023.
And
In the matter of: Tapas Barman @ Chhoto Buro
… petitioner
Mr. Amanul Islam, Mr. Sourav Mukherjee. …for the petitioner.
Mr. Binoy Kumar Panda, Ms. Debadrita Mondal. …for the State.
Heard the learned counsels for the parties. Perused the case diary. Considering the incriminating materials available in the case diary including the injury reports and medical documents of which a report dated 08.07.2025 shows fracture injury on finger/hand and the alleged role ascribed to the present petitioner, I do not consider this to be a fit case for granting anticipatory bail to the petitioner. The application for anticipatory bail being C.R.M. (A) 2352 of 2025 is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
