ORAL ORDER
1. In this writ petition, the petitioner has sought for the following reliefs: a) Issue a writ of Mandamus or any other writ order, directing the respondents to consider the representations made by the petitioner on dated:03/08/2023 as per Annexure-A, b) And consequently direct the respondents to correct/rectify his date of admission or date of joining for his service as 21/04/1995 instead of 01/08/1998 in all his service records maintained by the respondents as per Annexure-E. c) Grant such other order or direction which this Hon’ble court deems fit to grant in the facts and circumstances of the case in the interest of justice and equity. 2.
2. The case of the petitioner is that he was appointed as a daily wage worker in the office of the Mahadevapura Nagarasabha, Bengaluru on 21.04.1995. Thereafter, the said Mahadevapura Nagarasabha has been merged with

the BBMP. Thereafter, the petitioner was transferred from the Office of the Executive Engineer, Mahadevapura Division, BBMP, Bengaluru, to the office of the Deputy Commissioner (Administration), BBMP Head Office, Bengaluru. The petitioner has made representation to the respondent Nos.2 to 4 dated 28.06.2021 at Annexure-C requesting for regularizing his service. Thereafter, the Government has issued G.O dated 10.10.2022 vide Annexure-D regularizing 330 ‘D’ Group Employees. In the said Government Order, the date of joining of the petitioner into service has been mentioned as 01.08.1998 instead of 21.04.1995. Even the Executive Engineer, Mahadevapura Division, BBMP, vide letter dated 13.08.2019 at Annexure-E has recommended to make corrections in the Government Order dated 10.10.2022. Subsequently, the petitioner has also submitted a representation dated 03.08.2023 to the respondent No.3 seeking for correction in his service records in respect of his date of joining into the service. Since the

representation of the petitioner is not considered, the petitioner is before this Court. 3. The learned counsel for respondent Nos.3 and 5 submits that there is dispute with regard to the date of birth of the petitioner. If the petitioner produces necessary documents, his representation will be considered. 4. Heard the learned Additional Government Advocate appearing for respondent Nos.1, 2 and 4 and learned counsel for respondent Nos.3 and 5. 5. Since the representation submitted by the petitioner dated 03.08.2023 vide Annexure-A is not considered by the respondent No.3, it is suffice for this Court to direct the respondent No.3 to consider the representation of the petitioner dated 03.08.2023 vide Annexure-A.
6. Liberty is reserved to the respondents to seek for necessary documents from the petitioner by giving notice to the petitioner to furnish the same. Thereafter, the

respondents shall consider the representation of the petitioner in accordance with law and as expeditiously as possible, not later than three months from the date of receipt of certified copy of this order. 7. Accordingly, the writ petition is disposed of. Sd/- (H.T. NARENDRA PRASAD) JUDGE DM
