Neutral Citation No. - 2025:AHC:116498-DB Chief Justice's Court Case :- PUBLIC INTEREST LITIGATION (PIL) No. - 615 of 2025 Petitioner :- Manish Kumar Mall Respondent :- State of U.P. and 7 others Counsel for Petitioner :- Kaushal Kishore Mani Tripathi Counsel for Respondent :- C.S.C., Jagdish Pathak (S.C.) Hon'ble Arun Bhansali, Chief Justice Hon'ble Kshitij Shailendra, J.
1. This petition, purportedly in public interest, has been filed by the petitioner, seeking a direction to respondent no.2 - District Magistrate, Kushinagar to look into the matter raised by the petitioner and take appropriate action against the Village Pradhan.
2. Instructions have been produced by the respondents inter alia indicating that based on the allegations made, enquiry has been conducted wherein allegations have been found to be baseless.
3. Further allegations have been made that the petitioner's cousin has been contesting elections against the Gram Pradhan and the filing of the present petition is an outcome of the said election rivalry.
4. Copy of the instructions has been supplied to counsel for the petitioner who has made vehement submissions that the enquiry report is baseless and against the status and therefore, this Court must interfere.
5. Having gone through the averments made in the petition which are very sketchy, we find that only stray allegations have been made without any material.
6. Once, based on a complaint, an enquiry has been conducted and the official respondents have reached to a particular conclusion, the insistence on part of the complainant that the report be rejected and the persons against whom allegations have been made be held guilty, cannot be countenanced in a petition of the present nature.
7. Consequently, we do not find any reason to entertain the present petition, the same is therefore, dismissed. Order Date :- 18.7.2025 AHA/AKShukla (Kshitij Shailendra, J) (Arun Bhansali, CJ) Digitally signed by :- AFZAL HUSAIN ABBASI High Court of Judicature at Allahabad
