2. The petitioner has been made accused in connection with S.T. Case No. 170 of 2024 arising out of Lokainayanpur P.S. Case No. 05/2020, for the offences registered under Sections 395 & 397 of the I.P.C. and Section 27 of the Arms Act, pending in the Court of learned Additional Sessions Judge-V, Giridih.
3. On 10.07.2020, between 02:00 pm to 03:30 p.m., the informant was waylaid by 10-12 unknown persons near Barmasiya More. The unknown dacoits looted his mobile phone, Rs.10,000/- and other articles.
4. It was submitted that the petitioner is neither named in the F.I.R., nor he was put on T.I. Parade. It was further submitted that nothing incriminating has been recovered from the possession of the petitioner and co-accused Kuldeep Ravat has been granted bail by a Co-ordinate Bench of this Court vide B.A. No. 10900 of 2023.
5. Mr. Rakesh Kumar Sinha, learned A.P.P. has opposed the prayer for bail and submitted that the petitioner has got criminal antecedent.
6. Considering the fact that there is no cogent material against the petitioner on the record, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-V, Giridih in connection with S.T. Case No. 170 of 2024 arising out of Lokainayanpur P.S. Case No. 05/2020.
