2 For Petitioner : None For Respondent No. 2 : Mr. Vaibhav A. Goverdhan, Advocate Hon’ble Shri Justice Rakesh Mohan Pandey
Judgment On Board 24/02/2025 1) Learned counsel appearing for respondent No. 2 submits that respondent No. 1 has passed away, but till date, petitioner has not taken any step to substitute the legal representatives of Ajit Pramod Kumar Jogi/ respondent No. 1. He further submits that the Hon’ble Supreme Court in the matter of Collector, Bilaspur Vs. Ajit P. K. Jogi, AIR 2012 SC 44 directed the State Government and Commissioner to verify/ scrutinize social status/ caste certificate issued in favor of Lt. Ajit Promod Kumar Jogi and decide it after giving due opportunity of hearing. He contends that this contempt petition was filed on 29.11.2016 on the ground that State authorities failed to comply with the order(s)/ direction(s) issued by the Hon’ble Supreme Court in the its
order dated 13.10.2011. He further contends that the order passed by Hon’ble Supreme Court has already been complied with and the social status/ caste certificate issued in favor of Lt. Ajit Pramod Kumar Jogi has been canceled and thus, nothing survives for adjudication in the present contempt petition. 2) Heard. 3) Firstly, there is no representation on the part of petitioner and secondly, petitioner has not taken any step to implead the legal representatives of Lt. Ajit Pramod Kumar Jogi/ respondent No. 1. Further, the order passed by the Hon’ble Supreme Court has already been complied with and there was no time-bound direction to verify/ scrutinize the social
3 status/ caste certificate of respondent No. 1, therefore, in the opinion of this Court, nothing survives for adjudication in the present contempt proceeding. 4) Consequently, this petition stands dismissed. Respondent Nos. 2 to 4 are hereby discharged. Sd/- (Rakesh Mohan Pandey) JUDGE Ajinkya
