1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending her arrest in connection with Crime No.183/2025 registered at Police Station – Dabhara, GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.07.04 16:35:02 +0530
2 District Sakti (C.G.) for the offence punishable under Section 108 Read with Section 3 (5) of Bhartiya Nyay Sanhita-2023 (As per FIR). 2. Case of the prosecution, in brief, is that the deceased Pushpa Chandra was married with the co-accused Sanjay Chandra at Village Katekoni 09 years prior with Hindu Rights and Rituals and out of their wedlock, one Baby girl born out. After the marriage of one year, the family members of co-accused Sanjay Chandra were torturing the deceased. Further allegation is that the husband of deceased Sanjay Chandra while consuming liquor committed marpeet with the deceased and ousted from matrimonial house and therefore on 02-03-2025, the deceased committed suicide taking some unknown poison and during the treatment, she died, thereafter the parents of deceased lodged FIR against the present applicant along with other co-accused persons. 3. It has been argued by learned counsel for the applicant that the applicant is the mother-in-law of the deceased and marriage of applicant's son who is co-accused namely Sanjay Chandra was solemnized with the deceased nine years ago in 2016 and for the reasons best know to the deceased she committed suicide by consuming sindoor (vermilion) and the husband and the father-in- law of the deceased were granted regular bail by the trial court. 3 Therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. 5.
Considering the facts & circumstances of the case, also considering the fact that husband and the father-in-law of the deceased were granted regular bail by the trial court and also considering the fact that investigation and trial are likely to take time, therefore, I am inclined to grant anticipatory bail to the present applicant. 6. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Laxmibai Chandra, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such fact to the Court. (c) The applicant shall appear before the trial Court on each and every date given to her by the said Court till
4 disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
