(Oral) Applicant Purnima Sardar is in judicial custody in FIR No. 32 of 2022, under Sections 302, 304B, 498A, 201 and 34 IPC, Police Station Sitarganj, District Udham Singh Nagar. She seeks her release on bail. 2. This is third bail application of the applicant. Her first and second bail application have been rejected on 29.03.2023 and 26.02.2024, respectively. 3. Heard learned counsel for the parties and perused the record. 4. Learned counsel for the applicant would submit that the applicant is in judicial custody for more than thirty-eight months; she was arrested on 27.01.2022; there are 30 witnesses, out of which only 16 witnesses have been examined; the applicant is 70 years of age; there is no direct evidence against her; merely because she was present in the home, she has been implicated in the case. 5. Learned State Counsel admits that out of 30 witnesses, only 16 witnesses have been examined. 2 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The third bail application is allowed. 8. Let the applicant be released on bail, on her executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
