SREENIVASA REDDY CRIMINAL PETITION NO.7252 0F 2024 ORDER:I The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioners herein/Al to A3 to grant anticipatory bail in connection with Crime No.468 of 2024 of Tadepalli Police Station, Guntur District, registered for the offences punishable under Sections 341, 307 and 506 read with 34 lPC. 2. Case of the prosecution is that on 14.10.2024, the defacto complainant filed a report before the police stating that on 18.04.2024, he, along with his friend, attended the nomination program of Sri Nara Lokesh at Mangalagiri and thereafter, they were proceeding towards CSR road, where the accused stopped them and picked up quarrel with them with an intention to kill them, AI caught hold his throat and also threatened with dire consequences. 3. Heard. Perused the record. 4. On perusal of the material on record goes to show that a case in Crime No. 211 of 2024 of TadepaIIi Police Station has been registered pursuant to a report lodged by petitioner No.1 herein for the offence punishable under Section 337 lPC. During the course of _,-__.i =ri--e=+_RE_ `-- --` - + 2 J9 investigation, the Section of law was altered to section 304 II IPC. On 18.04.2024, the alleged incident in the present case was said to have taken where the informant received grievous inJ-urieS. After lapse of six months, basing on the statement of the accused in Crime No.211 of 2024, the police regI-Stered a case as against the defacto complainant I'n Crime No.211 of 2024 on the ground that they are alleged to have beaten the defacto complaI-nant in the Present Crime. Moreover, when the complainant in present crime was produced before the Court, he did not make any mention of the aforesaid incident. After lapse of six months, basing on the statement given by the informant in crime No.211 of 2024, the Present Crime has been registered. o 5. In vI'eW Of the aforesaid facts and circumstances of the case, this Court is inclined to consider request of petitioners for grant of anticipatory bail. 6. Accordingly, l'n the event of their arrest, petitioners herein shall be released on bail on each of them executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for the like sum each to the satisfaction of the arresting police officials, and also on condition that the petitioners Q -==- ci-- i> *`.-± r- shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to the prosecution witnesses. The petitioners shall appear before the Station House Officer concerned once in a week I-.e. On every Sunday between 10.00 a.m. and 01.00 p.m., till filing of the charge sheet. 7. Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
