Criminal proceedings arising out of crime No. 734/2016 of MICO Layout Police Station, registered on a complaint lodged by respondent No. 2 herein is sought to be quashed in this petition. 2. FIR was registered against accused Nos.1 to 4 for offences punishable under Sections 498-A and 420 of Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act, 1961. 3. The Police have filed charge sheet against the petitioner alone under Sections 498-A and 420 of Indian - 3 - NC: 2025:KHC:12999 CRL.P No. 9985 of 2022 Penal Code and Sections 3 and 4 of Dowry Prohibition Act, 1961. 4. The matter arises out of a matrimonial dispute. It is submitted by the learned counsel appearing for the petitioner as well as respondent No. 2/defacto complainant that the dispute has been resolved and the parties have entered into a settlement before the Family Court, Benglauru, in M.C. No. 5871/2019 wherein, the marriage of the parties solemnized on 07.02.2014 has been dissolved. 5. Learned counsel appearing for respondent No. 2, on instructions, submits that the parties have settled all the disputes and respondent No.2 has no objection to quash the present criminal proceedings. He has filed a memo signed by respondent No. 2/defacto complainant wherein it is stated that she has no objection to allow the petition and to quash the FIR, complaint, charge sheet and the entire proceedings. 6. Learned counsel appearing for the parties submits that now case is pending in C.C. No. 5238/2018 before the CJM, Bengaluru. - 4 - NC: 2025:KHC:12999 CRL.P No. 9985 of 2022 7. In view of the settlement between the parties, no purpose would be served in keeping the proceedings pending against the petitioner. The matter arises out of a matrimonial dispute. Therefore, to bring quietus to the case, it is just and necessary to quash the proceedings. 8. Accordingly, the following; O R D E R i. Petition is allowed. ii. Entire proceedings in C.C.
