GP FOR REVENUE The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a issue an appropriate writ, order or direction more in the nature of Mandamus, declaring the action the action of the respondents No 2 to 5, in not to take any steps in pursuance of the complaint lodged by the petitioner against the unofficial respondents No 6 to 9, dated on 02-07-2025, high handily, encroachedand make illegal construction in my land Sy No 199/2 to an extent of land Ac.00.05 cents. Plot No 36 at Kattipudi village, Sankhavaram Mandal, and Andhra Pradesh, the unofficial respondents No 6 to 9 are encroached my land and made construction as being illegal, arbitrary and in violation of Articles 14,21 and 300-A of the Constitution of India, and consequently direct the respondents No 2 to 5, to forthwith consider the representation dated 02-07-2025, and demolish illegal construction in my land.” 2. Heard Sri M.Chalapathi, learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue. 3. Learned Assistant Government Pleader for Revenue would submit that a civil suit is pending before the competent Civil Court. During the pendency of the said suit, the petitioner has submitted a representation for the removal of unauthorized construction, which cannot be acted upon as the matter is ceased by the authority of competent Civil Court. 4. Recording the said submission, the Writ Petition is disposed of. However, the Petitioner is at liberty to pursue his remedy before the 3 competent civil Court where the civil suit is pending. There shall be no order as to costs.
