IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 240 of 2025 Nikhil Kumar Gupta, aged about 28 years, son of late Madan Kumar Gupta, resident of Manjhi Tola, Chandni Chowk, Adityapur, P.O.+ P.S.- Adityapur, District- Saraikella-Kharsawan … Petitioner - Versus - The State of Jharkhand … Opp. Party ------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH ----- For the Petitioner : Mr. Sanjaya Kumar Jha, Advocate For the State : Mr. Tarun Kumar, A.P.P. --- 02/17.01.2025 Heard the parties. The petitioner has been made accused in connection with S.T. Case No.201 of 2022, arising out of Adityapur P.S. Case No.136 of 2022, for the offences registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Additional Sessions Judge-I, Seraikella. Bail Application of the petitioner was earlier rejected by this Court vide B.A. No.7647 of 2024 by order dated 28.10.2024. The husband of the informant was murdered by unknown persons outside his house. It appears that during the course of investigation, petitioner was apprehended and, on his confession, the diamond ring, belonging to the deceased was recovered. It further appears that the petitioner was put on T.I. Parade and he was identified by the informant as one of the assailants. Learned counsel for the petitioner submitted that petitioner is suffering from cancer and medical treatment is going on. Considering the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected once again. Petitioner, if so advised, may move before the learned Additional Sessions Judge-I, Seraikella for directing the Jail Authorities to refer him to higher center, if special treatment is required.
