This Court, by interim order dated 06.08.2024 stayed the operation and execution of impugned notification dated 31.07.2024 (Annexure-E). 3. Today, during the course of hearing, when the learned Additional Government Advocate was asked to answer as to how the transfer of the petitioner is effected when this Court had directed the Government to continue the petitioner at Davanagere till his retirement by order dated 03.04.2024 in W.P.No.2080/2024, the learned Additional Government Advocate on getting instructions by afternoon has filed an affidavit dated 04.02.2025 of the Principal Secretary to Government, Department of Commerce and Industries, enclosing a Notification dated 04.02.2025 wherein the impugned Notification dated 31.07.2024 insofar as petitioner is concerned is withdrawn. 4. In the affidavit of the Principal Secretary to Government, Department of Commerce and Industries it is stated that by over-sight and inadvertence, the name of - 4 - NC: 2025:KHC:5079 WP No. 21194 of 2024 the petitioner appeared in the impugned notification dated 31.07.2024 and he has rendered unconditional apology. 5. In view of withdrawal of the impugned notification dated 31.07.2024 insofar as petitioner and 3rd respondent is concerned, the grievance of the petitioner would no more survive for consideration.
