The present Special Leave to Appeal has been filed on behalf of the Appellant under Section 419(4) of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking leave to appeal against the impugned judgment and order of acquittal passed by the learned Civil Judge/Judicial Magistrate, Gopeshwar, District Chamoli, in Criminal Complaint Case No. 296 of 2023, titled “Prakash Chandra vs. Sandeep Bhandari”, pertaining to the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. 4. Upon consideration of the submissions advanced by learned counsel for the Appellant, this Court is of the view that, at this stage, sufficient grounds exist to grant leave. Accordingly, the Special Leave to Appeal is granted. 5. The Registry is directed to prepare the paper book and supply copies thereof to learned counsel for the parties, in accordance with the Rules. 6. Objections, if any, be filed by the Respondent. 7.
