1. Heard learned counsel for the petitioners, learned Standing Counsel for the State- respondents and perused the record.
2. This petition has been filed for the following relief:
"(i) Issue a writ, order or direction in nature of certiorari quash the order dated 27.3.2024 passed by Commissioner Chitrakoot Dham Mandal Banda in revision no. 00462 of 2018 Haribhan Singh and others Versus Jagdev Singh and another order dated 19.2.2018 passed by Sub Divisional Officer in appeal no. 1787 of 2017 Haribhan Singh and others Versus Jagdev Singh and another and order dated 26.12.2013 passed by Tehsildar Hamirpur in case no. 76 of 2013 Under section 34 of U.P. Revenue Code (Annexure-1,6 and 4 to the writ petition)."
3. Contention of the learned counsel for the petitioner is that the petitioners on the basis of an unregistered will executed in favour of them are claiming their rights over the land in dispute.
4. This matter arises out of proceedings under Section 34 of U.P. Land Revenue Act. The proceedings under Section 34 of the U.P. Land Revenue Act are summary proceedings which are only meant for the fiscal purpose and do not decide the rights of the parties in view of judgment passed in case of Smt. Kalawati vs. Board of Revenue reported in 2022 4 ADJ 578, therefore, I am not inclined to interfere in the matter.
5. Accordingly, the writ petition stands disposed of with liberty to the petitioner to get his rights declared in a regular proceedings. Order Date :- 21.3.2025 Ved Prakash (Manish Kumar Nigam,J.) Digitally signed by :- VED PRAKASH SHARMA High Court of Judicature at Allahabad
