Learned counsel for the State has pointed out that a bare perusal of the bail rejection order passed by the trial Court dated 19.06.2025 would show that the present bail application of the applicant has been filed in relation with the offences under Sections 294, 186, 353, 323, 341, 427, 34 of BNS and also under Section 3(2)(va), 3(1)(r)(s) of 2 Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989; therefore, against the said order Criminal Appeal under Section 14(A) of the Act of 1989 would be maintainable. It has been further pointed out the bail was rejected by Sessions Court as the Special Court was on leave and on the basis of work distribution, the said Court has decided the matter. 2. In view of the same, the applicant seeks to withdraw this application with liberty to file criminal appeal. 3. Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
