2. Shri Ajay Mishra, learned counsel appearing for the applicant submits that in the judgment dated 21.06.2023 passed by this Court in First Appeal No. 365/2019, at paragraphs 2 and 6, due to typographical mistake, Khasra No.379 has wrongly been mentioned in place of Khasra No.389, which is to be rectified.
3.
Learned counsel for the non-applicants have raised no objection with regard to the above contention of the counsel for the applicant.
4. From perusal of the record, it reflected that a suit for Specific Performance of Contract was filed by the appellant/plaintiff in respect of suit property, comprising of Khasra Nos. 315/2, 389, 320/2, 320/3 and 320/4, admeasuring 1.63 acre, situated at Khamtarai, P.H.No.17, Tahsil and District Bilaspur, but inadvertently, in the judgment dated 21.06.2023, “Khasra No.379” has wrongly been typed in place of
“Khasra No.389” .
5. In view of above, the petition is allowed and Khasra No.379, mentioned at paragraphs No. 2 and 6, shall be read as “Khasra No.389” in the
judgment dated 21.06.2023 passed by this Court in First Appeal No. 365/2019. The judgment is modified to this extent. This order shall be made as a part and partial of the judgment dated 21.06.2023. The other observations made in the judgment shall remain intact. Registrar (Judicial) is directed to do the needful.
6. With the above correction/modification, the M.C.C. stands disposed of at the admission stage itself. Sd/- Sd/- (Sanjay S. Agrawal)
