01. This Misc. Civil Application is filed for transfer of Hindu Marriage Petition No. A-90 of 2024 from the Family Court, Jalgaon to the Family Court, Akola. The matrimonial proceeding is filed by respondent- husband for restitution of conjugal rights.
02. It is submitted by the learned Advocate for the applicant that the applicant is residing with her old aged parents at Akola. The distance between the two places is about 185 kms. There is nobody to accompany the applicant for attending the proceedings at Jalgaon.
03. Taking into consideration convenience of applicant-wife, it would be in the interest of justice to transfer the proceeding from Jalgaon to Akola. Hence, following order :- 2025:BHC-AUG:5143

ORDER i) This Misc. Civil Application is allowed in terms of prayer clause (B). ii) After transfer of the proceeding the applicant-wife shall not seek unnecessary adjournments and co-operate in early disposal of the proceeding. If the Trial Court finds that the adjournments are necessarily sought, the Trial Court shall pass appropriate orders compensating the respondent- husband, if he personally remains present in the Court. iii) The Trial Court shall make endeavour to dispose off the proceeding as early as possible and preferably within one year from the date of transfer.
