This anticipatory bail application under Section 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Sections 406/407/409/420/120-B I.P.C. 3. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 4. It is alleged that consignment of iron rods, etc. was sent from the factory of Electrosteel Steel Ltd., Siyaljori to Alwar by a truck. The truck did not reached the destination. The informant who is the Business Manager of Zinka Logistics Solution Pvt. Ltd., has sent the huge consignment through this petitioner’s company, but the same did not reached the destination. As a result of which this case has been lodged. 5. After hearing the parties and after going through the documents, I find that the consignment was sent through the transporter Zinka Logistics Solution Pvt. Ltd. Admittedly, the vehicle also does not 2025:JHHC:17533 2 belong to this petitioner. The petitioner is the proprietor of different logistics company. There is nothing on record to suggest that there was some agreement between Zinka Logistics Solution Pvt. Ltd and the company of this petitioner. Only the written statement has been made in the FIR that Zinka Logistics Solution Pvt. Ltd company has sent the material through the company of this petitioner. 6. Learned A.P.P. for the State also admits that there is nothing in the case diary to suggest that there was some contract between Zinka Logistics Solution Pvt. Ltd and the company of this petitioner. 7. Considering the aforesaid fact that there is no document to suggest that there was link between this petitioner’s company and Zinka Logistics Solution Pvt. Ltd. and the petitioner is not even the registered owner of the vehicle which went missing, this Anticipatory Bail Application stands allowed. The petitioner above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Court of J.M.F.C., Bokaro in connection with Siyaljori P.S. Case No. 04 of 2021, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. 2025:JHHC:17533 3 8.
