GP FOR HOME The Court made the following: COMMON ORDER: Writ Petition No.33297 of 2022 is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the respondents in not tracing out petitioner's missing son Mr.Kumptla Hanuveer duly conducting necessary investigation in FIR No.206/2022 dt.13-08-2022 and in not taking steps to apprehend the suspects for missing of his son as highly illegal, arbitrary and contrary to law and consequently direct the respondents to place the progress of investigation in FIR No.206/2022 and the steps taken by them to trace out the missing person in the said FIR forthwith before this Hon'ble Court.” Writ Petition No.23472 of 2023 is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the respondents 3 to 6 in not conducting the investigation in FIR No.206/2022 on the file of the 6th respondent police station in a fair and proper manner and in not ascertaining the whereabouts of petitioner's missing son Mr.Kumpatla Hanuveer though one year has elapsed and in not taking action against the suspects for missing of his son as highly illegal, contrary to the law and unconstitutional and consequently direct the respondents 1 to 3 to entrust the investigation in FIR No. 206/2022 to either the Special Investigation Team or CBCID for proper and fair investigation in the interest of justice.” 3 2. Sri Turaga Sai Surya, learned counsel for the Petitioner would submit that, let there be a direction to the Police to conduct a fair investigation in this matter or the investigation may be transferred to CBCID. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that the investigation in FIR No.206/2022 on the file of Amalapuram Town Police Station, is pending and the Police are making hectic efforts to trace out the missing son of the Petitioner. Learned Assistant Government Pleader would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petitions are disposed of directing the Police to look into the points raised by the Petitioner in his affidavit, conduct a fair investigation, inform the progress of the investigation to the Petitioner, conclude the investigation and file a report as expeditiously as possible, since the crime is of the year 2022. At the same time, Petitioner herein is also directed to assist the Police by furnishing the information which is available with him to enable the Police to trace out the missing son of the Petitioner. There shall be no order as to costs.
