BHARDWAJ, J (ORAL) Challenging the order dated 14.07.2023 whereby the claim of the petitioner for promotion has not been considered on the ground that only those employees who have passed the type test were to be considered for promotion alleging that there is no such condition in the Service Rules, 1998, the instant writ petition has been filed by the petitioner. 2 In the written statement, a plea has been taken by the respondents that vide Haryana Transport Department (Group C) Transport Commissioner Office (Amendment) Rules, 2013, after Rule 9, Rule 9(A)(1) has been inserted mandating the requirement of passing of a type test and/ or SETC at the option of the Clerks who had already been promoted from Group D and Restorers etc. 3 On being confronted with the same, learned counsel for the petitioner seeks withdrawal of the instant writ petition so as to file an appropriate writ petition challenging the Rule, if so advised. 4 Disposed of as withdrawn with liberties as aforesaid.
