ORAL ORDER
1. Accused in Crime No.174/2025 registered by Kaggalipura Police Station, Ramanagara District, for the offences punishable under Section 108 of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail.
2. Heard the learned Counsel for the petitioner and the learned HCGP who is directed to take notice for respondent.

FIR in Crime No.174/2025 was registered by Kaggalipura Police Station, Ramanagara District, for the aforesaid offences against the petitioner based on the first information dated 17.05.2025 received from Vanajakshamma who is the mother of deceased Usha. During the course of investigation, petitioner was arrested on 18.05.2025 and subsequently remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.1146/2025 was rejected on 08.07.2025. Therefore, he is before this Court.

Learned Counsel for the petitioner submits that further proceedings in Crime No.174/2025 has been stayed as against the petitioner in Crl.P.No.7691/2025. Petitioner is in custody from 18.05.2025. Accordingly, he prays to allow the petition.

5. Per contra, learned HCGP who has opposed the petition, however, does not dispute the submission made by the learned Counsel for the petitioner.
6. Perusal of the first information would go to show that deceased Usha is the wife of the petitioner and their marriage was solemnized on 21.04.2018. It appears that deceased had committed suicide on the intervening night of 16.05.2025 and 17.05.2025 by hanging herself. Further proceedings in Crime No.174/2025 registered Kaggalipura Police Station has been stayed by the coordinate bench of this Court in Crl.P.No.7691/2025 by order dated 12.06.2025. Under the circumstances, I am of the opinion that without expressing any opinion on the merits and demerits of the case, the prayer made by the petitioner to enlarge him on regular bail is required to be answered affirmatively. Accordingly, the following order:
7. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.174/2025 registered by Kaggalipura Police Station, Ramanagara District, for the

offences punishable under Section 108 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
