This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest in connection with Complaint Case No.1148 of 2024, for offences under Sections 47(a) & (e) of the Excise Act, 2015. The case is presently pending before the Court of learned Sub Divisional Judicial Magistrate, Chandil. 3. It is alleged that from the premises of petitioners, 1305 liters of whisky was recovered. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 6. Considering the recovery, I am not inclined to grant anticipatory bail to these petitioners. 2025:JHHC:17375 2 7. Accordingly, this Anticipatory Bail Application stands dismissed. 8. The petitioners are directed to appear before the Court concerned and pray for regular bail, which will be considered on its own merit and the material available on record including the consideration of ownership of house from where the recovery was effected, and without being prejudiced by the order of dismissal passed by this Court.
