(2) An ex parte order dated 10.6.2022 was passed by Labour Court, Haridwar against the petitioner in proceedings under Section 33C(2) of Industrial Disputes Act, 1947. In this writ petition, petitioner (employer) has challenged the orders passed in the execution proceedings, initiated pursuant to said ex parte order. (3) Learned Counsel for the petitioner submits that petitioner has moved an application seeking recall/review of the ex parte order dated 10.6.2022. He prays that writ petition may be disposed of directing the Labour Court to consider and decide petitioner’s recall/review application. (4) Having regard to the fact that petitioner has approached the Labour Court seeking recall/review of the ex parte order dated 10.6.2022, writ petition is disposed of with a request to Court below to consider and decide petitioner’s application seeking recall/review of the said order, as per law, within six weeks from the date of production of certified copy of this order. While considering petitioner’s recall/review application, it shall also be examined whether such application is maintainable or not.
