On the matter being taken up, learned A.G.A. submits that though the applicant has challenged the order dated 05.03.2025 whereby the application dated 05.03.2025 of the applicant has been rejected but the order dated 04.03.2025 whereby the opportunity of the applicant to produce the defence witness has been closed, has not been challenged. In response, learned counsel for the applicant submits that the applicant may be allowed to withdraw the instant application U/s 528 BNSS with liberty to file fresh Application U/s 528 BNSS with better particulars. Learned A.G.A. has no objection to such prayer of the applicant. In view of the above, the instant application U/s 528 BNSS is dismissed as withdrawn/not presses with liberty as prayed for. Office is directed to return the certified copy of the documents to the counsel for the applicant by tomorrow after retaining the xerox copy of the same on record.
