The Petition coming on for hearing, upon perusing the Petition and the me.morandum of grounds filed in support thereof and the earlier orders of the High Court order dated 22.10.2024, 05.ll.2024,ll.ll.2024, 26.ll. 10.12.2024 made herein and upon hearing the arguments of Sri V:#s#h: Advocate for the Petitioner, and of Public Prosecutor, for the Respondent, the Court made the following; THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 7182 of 2024 ORDER: The Criminal Petition, u/See.482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A59 to grant anticipatory bail in connection with Crime No.208/2024 of Tadipatri Town Police Station, Ananthapuramu District. 2. A case has been registered the petitioner and others for the offences punishable under Section 147,148,188, 324, 307 r/w 149 IPC. 3. The case of the prosecution in brief is that: On 14.5.2024 at about 3.30 pm at Ragithotapalem, Tadipatri town, Al and his sons and followers i.e. A2 to A62 and some others formed themselves into an unlawful assembly and armed with deadly weapons, due to political rivalry between two opposite groups, hurled stones and attacked with sticks and also damaged property, and in that incident, the defacto complainant sustained bleeding injuries on his nose and he took treatment in Tadipatri town. Basing on the report lodged by the defacto complainant, the FIR came to be registered. 4. Heard. Perused the record. 5. Learned Assistant Public prosecutor submits that the investigation is still pending and some more witnesses are yet to be examined. 6. A perusal of the material available on record goes to show that there Were aS many aS Seven Cases registered against both the ParitieS. There -.,I was a quarrel enshrined between the defacto complal'nant and the accused party. ln connection with that, some stones were thrown by either side wherein the defacto complainant sustained injury on his eye. The alleged incident is said to have taken place on 14.5.2024. Quite surprl'singly complaint has been lodged on o9.10.2024 and there is no explanation as to why so much delay has been caused in lodging the complaI-nt. No specific overt acts have been attrl'buted agal'nst this petl-tioner in partl'cular. ln view of the aforesaid facts and circumstances, thl's court is inclined to grant the Prayer Of the Petitioner for antiCl®PatOry bail. 7. Accordingly, in the event of his arrest with regard to thl-s crime, Petitioner/A59 shall be released on bail on his executing a personal bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties for the like sum each to the satisfaction of the arresting police offI-Cials and also on condl-tl'on that the petl'tioner shall make hI'mSelf available for investigation as and when required and that he shall not cause any threat, inducement or Promise tO the Prosecution Witnesses. The petI-tiOner Shall appear before the Station House Officer concerned, once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filing of the charge-sheet. 8.
