Shahi, learned Additional Chief Standing Counsel has been directed by this Court to represent the Nagar Panchayat Suriyawan, Bhadohi. The petitioner's claim for appointment on compassionate grounds after the death of his father was rejected by this Court for the first time in Writ A No. 9014 of 2023 (Rajendra Dom Vs. State of U.P. and others) by order dated 06.07.2023. The petitioner claims that his mother was also working as a contractual employee in the Nagar Panchayat Suriyawan as a Safai Karmi. The mother of the petitioner does not come within the definition of government servant as provided in Rule 5 of the UP Recruitment of Dependants of Government Servants Dying in Harness Rules, 1974. These facts were duly examined by the learned Single Judge in the judgement dated 06.07.2023. In effect this is a second writ petition on the same cause of action. The writ petition is accordingly dismissed.
