WPA 14944 of 2025
Ajay Debnath & Anr. -Vs- The State of West Bengal & Ors.
Mr. Debarshi Brahma Mr. Subarna Bank
… for the Petitioner(s)
Mr. Nilotpal Chatterjee Mr. Soumalya Ganguli
… for the State-respondent(s)
Re
The petitioners are aggrieved by the fact that their boundary wall was demolished at the behest of the private respondents and the same was done inspite of the directions passed in TS 239 of 2025 wherein directions were for restraining the defendants from transferring the suit property to any third party.
Learned advocate for the State is present.
I have considered the contentions advanced by the petitioners and I am of the view that since the civil court is already in seisin of the subject dispute,
the petitioner would approach the said court for appropriate remedies.
In case, the petitioners are faced with any inconveniences, the police authorities would oversee that there is no breach of the peace and/or tranquility taking place as also no untoward incident resulting from the strained relationship existing between the parties.
With the aforesaid observations, WPA 14944 of 2025 is disposed of.
Pending application(s), if any, is also disposed of.
Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
