1. The petitioner is challenging an Official Memorandum dated 03.04.2014 passed by the Deputy Commissioner, which reads as follows:

2. As could be seen from the aforesaid Official Memorandum, the Deputy Commissioner has unilaterally directed his subordinates to remove the names entered in the revenue records. The same appears to be based on the reports of the Assistant Commissioner and the Tahsildar. - 4 -

3. However, it is clearly forthcoming from this order that the petitioner herein was not notified of either of the reports or the reasoning for passing of the order dated 03.04.2014. 4. In that view of the matter, the impugned order cannot be sustained and the same is liable to be quashed. 5. If the Deputy Commissioner is of the view that the entry of name of the petitioner in the records is improper, he would however be at liberty to initiate appropriate proceedings in accordance with law by issuing a notice to the petitioner, hearing him and thereafter passing an order. 6. The writ petition is accordingly allowed and the impugned Official Memorandum dated 03.04.2014 at Annexure ‘A’ is quashed insofar as it relates to the land belonging to the petitioner at serial No.2. 7. The writ petition is accordingly allowed. - 5 -

8. In view of the disposal of the petition, the pending interlocutory applications, if any, stand disposed of.
