Mr. Nikhil Bhatt, Advocate for the petitioner. Mr. Ganesh Kandpal, Additional C.S.C. for the State/respondents. It is a case of the petitioner that he has already rendered more than 15 years of service in Durgam Area. In view of the health condition of his daughter, he has sought transfer. The position at Government Inter College, Shivpur Bichuwa, Khatima, District Udham Singh Nagar is vacant, therefore, he may be transferred. Heard learned counsel for the parties and perused the record. Learned counsel for the petitioner would submit that the petitioner has sought transfer on the health ground of his daughter. He has already been allotted the school, but subsequently, he was not transferred on the ground that the position is not vacant. He would submit that though the position has got vacant on 31.03.2025. Learned State counsel, under instructions, would submit that if the petitioner moves a fresh representation, it will be considered at the time when the next transfer exercise is undertaken. The Court takes on record the statement given by learned State counsel. The writ petition is disposed of with liberty to the petitioner to move a fresh representation, which shall be considered when the next transfer exercise is undertaken.
