Learned counsel for the appellant has though made a feeble attempt to challenge the aforesaid order by contending that the same is illegal and perverse, yet we find that the order passed by the learned Family Court is only based on the plea raised, which was substantiated by way of evidence by the respondent/wife that she was prevented by sufficient cause from appearing before the Court. Since by way of the impugned order, only ex parte judgment and decree has been set aside and the divorce petition has been restored for its adjudication on merits, we find no reason to interfere with the impugned order passed by the learned Family Court. 4. In view of the above, we find that no indulgence is required to be granted to the appellant. However, we direct the learned Family Court to decide the divorce petition expeditiously preferably within a period of 06 months. 5. Appeal stands disposed of in above terms. 6.
