2. The petitioner has been made accused in connection with S.T. Case No. 218/2024 arising out of Palkot P.S. Case No. 27/2024 corresponding to G.R. Case No. 516/2024, for the offences registered under Sections 302/201 & 34 of the I.P.C., pending in the Court of learned Additional Sessions Judge-III, Gumla.
3. Deceased Charan Topno was missing since one month prior to the institution of this FIR. Petitioner and the co-accused persons have confessed that they had murdered the deceased. On the confession of petitioner and co-accused persons, skeleton and bloodstained wooden log was recovered.
4. It appears from the post-mortem report that the skeleton was that of a male aged about 36 +/ - five years. Cause of death is also opined to be injury on the face and thoracic injury on the sternum.
5. Learned A.P.P. has submitted that the bail application of the petitioner and co-accused persons have been rejected earlier.
6. Mr. Ritesh Kumar, learned counsel appearing on behalf of the petitioner has submitted that prior to recording of confession of this petitioner, confession of other co-accused Kamil was recorded.
7. All three accused persons were apprehended together. They together confessed their guilt. It is not a case that the accused persons were apprehended separately.
8. In view of the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, their prayer for bail stands rejected.
