1. This petition takes exception to the order dated 03.09.2024 passed by Trial Court below Exhibit 394. The petitioners are original plaintiffs, they filed Application Exhibit 394. Learned Trial Court though has observed that the application is pre-mature however went to dismiss the same. Petitioners- plaintiffs have grievance about the dismissal of the said application. 2. 3. This order clearly indicates that the Trial Court was not intending to reject the application on merit. However, it is said to be pre-mature. Once, Court comes to the conclusion that the application is pre-mature, question of rejection of the same does not arise. If such rejection is not set aside, the same will cause prejudice to the plaintiffs in pursuing the said application at appropriate stage of the proceeding.
