(At Present Confined At Central Jail, Kota). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Abdul Kalam Khan For Respondent(s) : Mr. N.S. Dhakar, PP Mr. Tapesh Agarwal, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 29/07/2025 1. The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.262/2021 registered at Police Station Vigyan Nagar, Kota City, District Kota for the offences punishable under Sections 147, 148, 149 and 302 of IPC and Section 3(2)(V) of SC/ST Act. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Learned counsel submits that petitioner is in custody since 17.09.2021 as such he has suffered incarceration for almost four years. Co-accused Rohit Kumar Dangoriya has been granted benefit of bail by Coordinate Bench of this Court and further custody of the petitioner would not serve any fruitful purpose. [2025:RJ-JP:28522] (2 of 2) [CRLMB-520/2025] 3. Learned Public Prosecutor opposes the submissions made by the learned counsel for the petitioner and submits that there is specific allegation against the petitioner to cause firearm injury against the deceased. It is also contended that the trial is at fag end. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, especially the fact that trial is at fag end, this Court does not find it a fit case to grant the benefit of bail. Accordingly, the present bail application is dismissed. Learned trial Court is requested to expedite the proceedings and make endeavour to conclude the trial at the earliest. 6. The observation made herein above is only for decision of the present bail application and would not have nay impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J pcg/37
