The present contempt case has been filed for initiation of contempt proceeding against the opposite party no.2 alleging wilful violation of the order dated 24th August, 2023 passed in W.P. (S) No.5713 of 2022. 2. Mr. Piyush Anand, learned A.C. to S.C.-VI, appearing on behalf of the opposite party no.2 refers to show cause affidavit filed on behalf of the opposite party no.2 (wrongly mentioned to have been filed on behalf of the opposite party nos. 2 & 3), paragraph no.6 of which reads as under: “6. That it is most humbly stated and submitted that in pursuant to the aforesaid order, the petitioner filed a representation along with the copy of the order dated 24.08.2023 passed by this Hon'ble Court before the answering respondent. In compliance of the order of the Hon'ble court the answering opposite parties paid the admissible retiral benefits to the petitioner under group insurance Rs.3,26,363/- dated 10.01.2024, after retirement leave encashment Rs.4,80,725/- dated 02.02.2024 traveling allowance after retirement of the petitioner Rs.68,880/- dated 03.02.2024, arrears of 1st and 2nd MACP Rs.1,89,488/- and arrears of 7th Pay Fixation Rs.30,18,713/- dated 15.02.2024 total Rs.40,84,169/- vide bill No.37/2023-24, 44/2023-24, 38/2023-24 and 48/2023-24 respectively and salary of earned leave commuted leave approved by departmental letter No. 2351 dated 08.08.2023 and pension of the petitioner is also fixed and the petitioner has started receiving his pension.” 3. Learned counsel for the petitioner submits that so far as the payment of retiral benefits after grant of 3rd M.A.C.P. to the petitioner is concerned, the same is still under process as would be evident from letter no.198(ii) dated 21st February, 2024 issued by the opposite party no.2 to the Under Secretary, Department of Food, Public Distribution and Consumer Affairs, Government of Jharkhand. 4. Be that as it may. 5. Since the opposite party no.2 has complied the order dated 24th August, 2023 passed by this Court in W.P.(S) No.5713 of 2022, there is no need to further proceed in the matter.
