SUTHAR Date : 22/08/2025 ORAL ORDER By way of present petition under Articles 226 and 227 of the Constitution of India and under Section 497(1) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner has sought for the release of muddamal vehicle which has been seized in connection with FIR No.11184002220656 of 2022 registered with Chhota Udepur, District Chhota Udepur for the offence under the Gujarat Animal Preservation Act, 2011, Prevention of Cruelty to Animals Act, 1960, Indian Penal Code and Motors Vehicle Act. Having heard the learned Advocate for the petitioner and learned APP for respondent – State of Gujarat. It appears that present is the successive petition filed by the petitioner and earlier also the petitioner has filed Special Criminal Application No.16008 of 2023, which was withdrawn with a view to avail statutory remedy available under the law as confiscation proceedings have been initiated. The learned APP has submitted that R/SCR.A/6010/2025 ORDER DATED: 22/08/2025 public notice for auction has already been issued for the muddamal vehicle. In view of above, no case to exercise powers under Articles 226 and 227 of the Constitution is made out. Hence, present petition is dismissed. (HASMUKH D.
