JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 09.09.2025 01. The instant contempt petition arises out of an order/judgment dated 20.11.2023 passed by this Court in WP(C) No. 268/2023 by virtue of which the writ petition preferred by the petitioner was disposed of with a direction to the respondents to consider the claim of the petitioner by treating the writ petition as a representation and respondents were also directed to take a decision thereon, strictly under rules, on the basis of averments made in the petition by passing a consideration order within a period of six weeks from the date a certified copy of the order along with complete set of writ petition was made available to the respondents. Since the aforesaid order was not complied with within the time granted by this Court, the instant contempt petition was preferred in which notice was issued on 13.05.2024. 03. Respondents have filed compliance report on 09.04.2025 in which they have taken a specific stand that the case of the petitioner has been accorded due consideration in conformity with the order passed by this Court and the claim of the petitioner after being considered stand rejected by virtue of the detailed speaking order dated 08.04.2025, which has been placed on record along with the compliance report. 04. I have perused the stand taken by the respondents in the compliance report and also have gone through the order of consideration passed by District Magistrate, Jammu dated 08.04.2025, which reveals that the case of the petitioner was accorded due consideration and was found to be devoid of any merit and stood rejected. 05. Since the direction passed by this Court was specific to the extent of according due consideration and thus, the respondents in conformity with the aforesaid direction has complied with the order/judgment dated 20.11.2023 passed by this Court in its letter and spirit, by passing a detailed consideration order, whereby the case of the petitioner stood rejected. Thus, this Court is of the view that the order/judgment dated 20.11.2023 passed by this Court stands complied with and no contempt is, accordingly, made out. 3 | P a g e CCP(S) No. 147/2024 IN WP(C) No. 268/2023 06. Accordingly, proceedings in the instant contempt are closed. Rule, if any, shall stand discharged. However, petitioner will be at liberty to challenge the aforesaid order by way of appropriate proceedings, if so advised. 07. Disposed of, accordingly.
