Heard the parties
2. The petitioner has been made accused in connection with S.T. Case No. 386/2023 arising out of Sarath P.S. Case No. 40/2023, for the offences registered under Sections 148, 149, 302, 307, 326, 341, 506, 134 of the I.P.C., pending in the Court of learned Additional Sessions Judge-I, Madhupur.
3. Bail Application of the petitioner was earlier rejected by this Court vide B.A. No. 8486 of 2023 by order dated 24.11.2023.
4. On 03.04.2023, the petitioner is alleged to have inflicted sword blow on the husband of the informant, due to which he succumbed to his injuries.
5. It appears that the trial of the case is under progress and the prosecution has examined as many as four witnesses.
6. Considering the nature of allegation and the fact that the trial is at the fag end of its conclusion, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected.
7. Learned Trial Court shall expedite the trial.
