Heard the parties.
The petitioner has been made accused in connection with Daltonganj Rail P.S. Case No. 43 of 2024, N.D.P.S. Case No.30 of 2024, for the offences registered under Sections 18(b)/22(c) of NDPS Act, pending in the court of Sri Niraj Kumar Srivastav, learned Principal District and Sessions Judge-cum-Special Judge (NDPS) Act, Palamau at Daltonganj.
On 21.11.2024, Railway Police Daltonganj apprehended the petitioner from Platform No.1 of Daltonganj Railway Station and recovered 1.5 kgs of opium from her possession.
It was submitted that the quantum of seized opium comes within the purview of intermediary quantity. It was further submitted that petitioner has got no criminal antecedent and this fact has been mentioned at paragraph-12 of the bail application.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Niraj Kumar Srivastav, learned Principal District and Sessions Judge- cum-Special Judge (NDPS) Act, Palamau at Daltonganj, in connection with Daltonganj Rail P.S. Case No. 43 of 2024, N.D.P.S. Case No.30 of 2024.
